Terms of Service

These Terms of Service ("Terms") govern your use of maliqe.com (the "Site") and your purchases from Maliqe Enterprise LLC ("Maliqe," "we," "us," or "our"). By using the Site or placing an order, you agree to these Terms. If you don't agree, please don't use the Site.

1. Using the Site. You may use the Site only for lawful purposes. You agree not to:

• misuse the Site;
• interfere with its operation or security;
• attempt to gain unauthorised access to it;
• use it to commit fraud or to infringe anyone's rights.

2. Accounts. If you create an account, you're responsible for keeping your login details secure and for activity under your account.

3. Products and pricing. We try to describe our fragrances and show their prices accurately. Scent is personal and may be perceived differently from person to person. Prices are shown in the currency for your region and may change without notice. If a product is listed at an incorrect price, or becomes unavailable, we may cancel the affected order and refund you in full.

4. Orders and payment. An order is an offer to buy. We accept it when we ship it. Payments are processed securely at checkout by Shopify and the payment method you choose, using the methods shown at checkout. We may refuse or cancel an order, for example if we suspect fraud or can't ship to your address.

5. Shipping and returns. Shipping is described in our Shipping Policy, and returns and refunds in our Refund Policy, both of which form part of these Terms.

6. Discount codes, promotions and store credit. Discount codes and promotions have no cash value, may have their own conditions, can't be combined unless stated, and may be withdrawn at any time. Store credit we give as part of a promotion is added to the account of the email address used for the qualifying order, once that order is paid:

• Discovery Trio: $10 per Trio, up to $30 per customer. Each credit can be used for 30 days.
• Discovery Set: $30, once per customer. It can be used for 60 days.

Store credit can be used only on full-size bottles (50 ml and 100 ml). It isn't earned on orders paid with store credit or a gift card, and unused credit earned on an order is removed if that order is cancelled or refunded. Credit expires at the end of its last day (US Central Time), has no cash value, and can't be transferred or exchanged for cash. Gift cards we sent before October 10, 2026 can be used until the date shown on the card.

7. Product safety. Our fragrances are for external use only. Do not apply to irritated or broken skin, and keep away from eyes, children, and open flame. Stop use if irritation occurs. Please check the ingredients listed on the packaging if you have known sensitivities.

8. Emails and text messages. If you sign up for our emails or text messages, you agree to receive marketing messages from Maliqe:

• Texts are sent by automated technology to the number you provide. Message frequency varies, and message and data rates may apply. Reply STOP to opt out or HELP for help. Consent isn't a condition of purchase.
• Emails: use the unsubscribe link in any email.

9. Reviews and content you share. If you post a review or other content, you confirm it's honest and your own, and you allow us to display and use it in connection with Maliqe. We may remove content that breaks these Terms.

10. Intellectual property. The Site and its content — including text, photography, design, and the Maliqe name and marks — belong to Maliqe or its licensors and may not be used without our written permission.

11. Third-party links and services. The Site may link to, or use, third-party services. We aren't responsible for their content or practices.

12. Disclaimer. The Site is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. Nothing in these Terms limits rights you have under consumer law that can't be excluded.

13. Limitation of liability. To the fullest extent permitted by law, Maliqe isn't liable for any indirect, incidental, special, consequential, or punitive damages. Our total liability for any claim relating to an order is limited to the amount you paid for that order.

14. Governing law. These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-law rules.

15. Changes. We may update these Terms from time to time. The version posted on the Site, with its "Last updated" date, applies to your use of the Site and to orders placed after that date.
